Terms of Use

1. About these terms

These terms are an agreement between you and'Untense LLP ("Untense", "we"). They apply to the Untense iPhone app and its related pages. By using Untense you accept these terms and our Privacy Policy. If you do not agree, please do not use the app.

2. Who can use Untense

You must be at least 13 years old to use Untense and at least 18 to buy a subscription, or older if the law where you live requires it.

3. Health and safety

Untense offers gentle movement sessions for general wellbeing. It is not a medical service. It does not diagnose, treat or prevent any condition and does not replace advice from a health professional.

  • Talk to a health professional before starting if you have a medical condition, an injury, are pregnant, or are unsure whether these movements suit you.
  • Move within a comfortable range. Stop if you feel pain, dizziness, shortness of breath or anything that worries you, and seek appropriate care.
  • The answers you give in the app help us suggest sessions. We cannot check them and they are not a medical assessment.
  • You are responsible for deciding whether a session is right for you.

4. Your account

You can use parts of Untense without an account. If you create one, give accurate information, keep your sign-in details private and tell us if you think someone else has used your account. You can delete your account at any time from the app.

5. Free plan and Premium

  • Free plan. One session per day, chosen by the app, with a presentation of Premium.
  • Premium. A subscription that unlocks the full library, removes the daily limit and removes the Premium presentations.
  • Price and period. The price and billing period are shown in the app before you buy, in your App Store currency.
  • Renewal. Subscriptions renew automatically for the same period at the price shown, unless you cancel at least 24 hours before the current period ends.
  • Cancelling. You cancel in your Apple account settings. Deleting the app does not cancel a subscription. After you cancel, you keep Premium until the end of the period you paid for.
  • Refunds. Purchases are made through the Apple App Store. Refund requests are handled by Apple under its own policy.
  • Restoring. You can restore a purchase from the app on a device signed in with the same Apple account.
  • Price changes. If a price changes, you will be told in advance as required by Apple and by law.

6. What you may do

We give you a personal, non-exclusive, non-transferable and revocable right to use Untense, for your own non-commercial use, on Apple-branded devices that you own or control, as permitted by the usage rules of the App Store terms (including Family Sharing where available). You agree not to:

  • copy, resell, redistribute or publicly share sessions, videos, illustrations or text from the app;
  • collect content or data from the app by automated means, or use it to build a competing product or to train software;
  • reverse engineer the app or bypass its technical protections or access limits;
  • use the app unlawfully or in a way that harms the service or other people.

7. Our content

The app, its sessions, illustrations, animations, text and brand belong to Untense or its licensors. These terms give you no rights in them beyond the right of use described above.

8. Changes to the service

We may add, change or remove sessions and features, and we may suspend or end the service. If we end a paid service, we will tell you beforehand where reasonably possible.

9. Suspension and closure

We may suspend or close an account that seriously or repeatedly breaks these terms. You may stop using Untense and delete your account at any time.

10. Apple App Store

These terms are between you and Untense, not Apple. Untense, not Apple, is responsible for the app and its content, and for any maintenance and support; Apple has no obligation to provide them. If the app fails to conform to an applicable warranty, you may notify Apple, which will refund the purchase price to the extent its terms provide; Apple has no other warranty obligation. Untense, not Apple, is responsible for addressing any claim relating to the app, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, consumer protection claims, and claims that the app infringes a third party's intellectual property rights.

You represent that you are not located in a country subject to a United States government embargo or designated as a "terrorist supporting" country, and that you are not on any United States government list of prohibited or restricted parties. You must also comply with any third-party terms that apply when you use the app, such as your wireless data service agreement, and with the App Store terms.

Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

11. Disclaimers

Untense is provided "as is" and "as available". To the extent the law allows, we make no promise that the app will be uninterrupted or error-free, or that it will produce a particular result for you.

12. Limitation of liability

To the extent the law allows, Untense is not liable for indirect or consequential losses, and our total liability to you is limited to the amount you paid us in the twelve months before the claim, or USD 100 if greater. Nothing in these terms limits liability that cannot be limited by law, or the rights you have as a consumer where you live.

13. Governing law and disputes

These terms are governed by the laws of England and Wales. Please contact us first so we can try to resolve any problem directly. Any dispute we cannot resolve together will be brought before the competent courts of England and Wales, unless the law where you live gives you the right to bring it before your local courts.

14. Changes to these terms

We may update these terms. We will announce important changes in the app or by email before they take effect. Continuing to use Untense after that date means you accept the new terms.

15. General

If part of these terms cannot be enforced, the rest still applies. If we do not enforce a right immediately, we do not give it up. You may not transfer your rights under these terms without our agreement.
